The compensation depends on loss or damage to your car, personal property, insurance deductibles and premiums, transportation, towing, lost income, childcare, and other related expenses. If a Kia or Hyundai car is not compatible with the software update, owners are eligible to receive up to $300 for anti theft devices. Final approval of the settlement must be granted by July 15 this year.

(KRON) — Over the past several years, thieves have discovered how relatively simple it is to steal Kias and Hyundais using a screwdriver and a USB cord. In 2023, Kias and Hyundais accounted for 38% of cars stolen in Berkeley, and auto theft spiked 61.5% in 2023 from the previous year, according to city officials.

Now, a preliminary class action settlement is giving Hyundai and Kia car owners affected by the industry failure some relief. On May 17, Oakland City Attorney Barbra J. Parker and Mayor Sheng Thao encouraged eligible car owners to access free anti-theft software upgrades and/or reimbursements worth “up to several thousand dollars,” city officials said.

According to city officials, people who bought or leased Kias or Hyundai models made from 2011 to 2022 with traditional key ignition systems could be eligible to receive the free anti-theft software upgrade and compensation provided by the settlement terms.

Compensation, according to city officials, is dependant on “loss or damage to your car, stolen personal property, insurance deductibles and premiums, and transportation, towing, lost income, childcare, and other related expenses.”

If eligible, officials said owners should receive an email with instructions on how to submit a claim. If owners never receive an email, they can go to the Kia or Hyundai settlement websites to find out if their car was included in the settlement and how to submit a claim.

If a Kia or Hyundai car is not compatible with the software update, city officials said owners are eligible for up to $300 “to cover anti-theft devices.”

The court must grant final approval of the settlement — which could be worth as much as $200 million — by July 15 this year. City officials said there may be appeals after that date. Car owners, however, are encouraged to submit their claims now, “but be aware they will not receive any funds until sometime after the settlement hearing.”
